Amend the IEP for one agreed change, without a meeting

Use an amendment request to propose a specific change to your child’s current IEP after the annual meeting. You and the district may agree to write the change into the document without gathering the team; either of you can ask for a meeting instead. You can send it today: paste it into an email, replace what sits in brackets, and write down the day the school received it; the table below says which day starts each clock.

What the rule says

“… the parent of a child with a disability and the public agency may agree not to convene an IEP Team meeting … and instead may develop a written document to amend or modify the child’s current IEP.”

A small fix can land in the document this month rather than waiting for next spring’s meeting.

When to send it

  • The team agreed to add a support at the last meeting and the IEP still reads the old way.
  • Your child’s occupational therapist moved to a different schedule and nobody updated the service page.
  • A new order from the doctor arrived in October and the accommodations list has not changed since August.

What the letter has to contain

The page and the line

A request to fix the IEP with no page number lands as a general complaint, and general complaints draw general answers.

The IEP states when each service starts and its frequency, location and duration. 34 CFR 300.320(a)(7)

The new wording

Wording you draft yourself is wording you can check afterward; wording left to the office comes back vague enough to argue over.

The date it was agreed

An agreement nobody dated is an agreement the next case manager has never heard of.

A copy of the amendment

Until revised pages reach you, the change lives in an email and not in the document staff read.

On request a parent gets a revised copy with the amendments incorporated. 34 CFR 300.324(a)(6)

If we agree to make this change without gathering the team, please email me the draft amendment and tell me how our agreement gets recorded. Please also send a revised copy of the IEP with the amendment incorporated.

If the district would rather convene, send me two or three dates. If the district declines the edit, I am asking for the decision and the reasons in writing, along with whatever the team looked at.

If no answer comes back

Give the office the count your state sets, starting the day the amendment request arrived.

  • Resend the message with the agreed date in the subject line so the record is one thread.
  • Put the question to the case manager plainly: amendment, or a meeting on the calendar.
  • Ask for the current IEP as an education record, which puts the wording question on paper.
