The IEP meeting happened, but no final IEP has arrived
The team sat down, talked through changes to your child’s IEP, and the meeting ended, but no finished document, changed page, or written record of what was decided has reached you since. No: once a meeting produces an IEP, the school has to give you a copy of it at no cost (34 CFR 300.322(f)). Start by pulling the IEP page or the letter the dispute turns on and writing down today’s date; every move below adds to that record.
What the rule says
“The public agency must give the parent a copy of the child’s IEP at no cost to the parent.”
34 CFR 300.322(f)
The pages the team produced in that room belong to you on paper, so you never need to rebuild the meeting from memory.
What to do this week, in order
Tonight, write out every change the team described in the meeting, in your own words, one line per decision, while it is still fresh.
Your dated meeting notes, one line per decision
Put your request for the revised IEP, with the amendments incorporated, in writing; the rule hands you that copy on request.
Your dated email asking for the revised copy34 CFR 300.324(a)(6)
Ask whether anything already changed in the classroom, such as a swapped service or a dropped accommodation, while the paperwork is still pending.
The case manager’s written answer about what changed and when
If no document arrives after a reasonable stretch, send a second dated request and keep a copy of both emails together.
A second dated email, kept with the first
What to put in writing
Replace what sits in brackets and send it by email, so the date is fixed.
- To
- Whoever finalizes the paperwork after a meeting, with the IEP coordinator copied in
Dear [IEP coordinator’s name], Our team met on [meeting date] and discussed [service or accommodation discussed] for [child’s full name], but I still do not have the finished IEP or the pages that changed. Please send the completed document with the changes to page [page] incorporated, and tell me whether anything already changed in class before it arrives. If any change we discussed was left out of the final pages, please treat that as a refusal and give me the reasons in the written notice form that 34 CFR 300.503 lays out. [Your name]
If the answer is no, it arrives as prior written notice: what was refused, why, and the records the district relied on (34 CFR 300.503(b)).
When to escalate, and to whom
Escalate when the written answer is a no, or when the record you built this week draws no answer at all.
| The path | The count | How it runs |
|---|---|---|
| A state complaint | 60 days to a decision | A signed letter to your state education agency about a violation inside the past year; the state decides in writing within 60 days.34 CFR 300.152(a), 300.153(c) |
| Mediation | Voluntary, at no cost to you | You and the district sit with an impartial mediator the state pays for; it can start before any complaint and may not delay a hearing.34 CFR 300.506(b) |
| A due process complaint | 2 years to file | A hearing before an impartial officer; the district holds a resolution meeting within 15 days, and the decision is due 45 days after the 30-day resolution period.34 CFR 300.507(a)(2), 300.510(a)(1), 300.515(a) |
Those counts are IDEA’s; your state may set its own window for due process, and publishes its own complaint form.
This page explains the federal rule, and it does not replace your state’s procedures, or advice from someone qualified to read your file.
