The school set a manifestation determination meeting and I don’t know what to bring

A string of suspensions, early pickups, or removals this year has led the school to schedule a meeting on whether the behavior connects to the disability, and it feels settled before you walk in. Not without you: within 10 school days of the decision to change placement, the district, you, and the relevant IEP team members review the whole file and make that call together (34 CFR 300.530(e)(1)). Start by pulling the IEP page or the letter the dispute turns on and writing down today’s date; every move below adds to that record.

What the rule says

“the LEA, the parent, and relevant members of the child’s IEP Team … must review all relevant information in the student’s file, including the child’s IEP, any teacher observations, and any relevant information provided by the parents”

What you hand in is part of the record the group reads, and you sit in that group as a member, not a bystander.

What to do this week, in order

  1. Build a dated log of every removal this year: the date, the length, the reason, and what the school called it.

  2. Request the discipline file, the IEP, any teacher observations, and the behavior data, since the review covers everything relevant in the file.

  3. Get the year’s total removal days in writing, since a series past 10 days can count as a placement change.

  4. Have the group confirm, on the record, whether the IEP was implemented before this happened, since that is the second question it decides.

  5. When the finding is no link to the disability, request the decision and its data in writing that same day.
